2/13/09:
The hearing for the Furlough Lawsuit was held today in Federal Court in Greenbelt, Maryland. The case was argued in front of Judge Alex Williams. Judge Williams granted the Unions request for further discovery and has allowed a 30 day time limit for this to happen. Judge Williams also advised after the discovery has been provided the Unions and the County would have an additional 21 days to file any additional written testimony. Myself and Vice President Christina Williams we in attendance and are very pleased with how the hearing went today and how the case was presented by Mr. Bruce Lerner. I will keep the membership updated on any further developements or hearing dates as the information becomes available.

Good afternoon. I would like to this opportunity to update the membership regarding the planned furloughs. We as the PCEA do not agree with the planned furloughs, at this time we do have a pending lawsuit, please understand that we cannot stop the furloughs from happening. At the Board meeting today it was discussed that employees are not being notified as to the status.  Please understand, I have been in many meetings with the Presidents of all Public Safety in the County, I am constantly on the telephone in conversations with our attorney.  We have delivered two letters so far to Chief Hylton and Director of Homeland Security, Vernon Herron, disputing the furlough plan and advising that in no way are our members waiving their rights by signing the "Furlough Deduction Form".  We will continue to update you on the status as soon as we hear anything from the County or the pending lawsuit.

The Public Safety Labor Coalition, which includes Fraternal Order of Police Lodge 89, International Fire Fighters Association, Prince George's County Local 1619, Inc., Deputy Sheriff's Association Prince George's County, Prince George’s County Correctional Officers Association, Inc., and the Police Civilian Employees Association,  is  jointly filing a lawsuit today challenging the County's Employee Furlough plan, CR-81-2008. The lawsuit claims that the furloughs are a violation of each organizations Collective Bargaining agreements, County Personnel Law, and the United States Constitution.  The lawsuit asks the courts to enjoin the furloughs and make everyone whole for any money they may have lost.  We will keep everyone posted of all developments.  Please refer to www.FOP89.org for additional information.

RETRO PAY
 FOR POLICE EMPLOYEES:
It has been brought to my attention that some members feel that their retro pay was calculated incorrectly (short). If you feel you did not receive the proper amount of retro pay, please look at your pay stubs and identify how much you were short and where the shortage occurred ( i.e. ot pay, acting pay) and then forward that information to Barbara Talbert in Fiscal Affairs and a copy to the PCEA and she will then send it to Upper Marlboro for re-calculation .

If you have any questions please feel free to contact me in the office 301-627-6841 or on my cell 240-417-5774
